Leonard Peltier beaten in prison

CANAAN, Penn. -- Leonard Peltier was jumped and severely beaten by a gang after being transferred from a prison in Lewisburg to Canaan on January 13. The family, however, was not notified by the prison and received the information by way of a letter from Peltier. Peltier, 64, was placed in solitary confinement.

"Once Mr. Peltier arrived at the Canaan prison facility, he was jumped by younger inmates, severely beaten, put in solitary confinement and placed upon meal restrictions despite his having diabetes and other medical conditions," the Leonard Peltier Defense Offense Committee said in a statement.

"The family has requested copies of the video tapes of that incident to no avail. It is as if the whole scenario was contrived to detract from the fact that Mr. Peltier has been a model prisoner having more than enough points to qualify for parole," LPDOC said.

Micheal Kuzma, an attorney for Leonard Peltier's defense, described the attack on Peltier in prison, during an interview with American Indian Airwaves with host Marcus Lopez, on Wednesday, Jan. 21. Kuzma said Peltier's sister Betty Peltier-Solano, executive coordinator of the Leonard Peltier Defense Offense Committee, received a letter from Peltier, but was never notified by prison officials of the attack. Peltier was transferred from Lewisburg to Canaan prison during the week of Jan. 12th and attacked on the 13th, by other inmates.

Kuzma said, "According to the letter, he thinks he might have a concussion. His middle finger on his left hand is either broken or badly injured. He has a large bump near his right wrist. The right side of his rib cage and chest are in pain. He also has a bruise on the right side of his chest. He also has a bruise on his left knee, and is suffering from headaches. These headaches are a direct result of the Jan. 13 beating."

Peltier called his neice, Kari Ann Cowan, from the prison on Jan. 22. During the live online NAMAPAHH Blog Talk Radio hosted by Robin Carneen, Cowan relayed the information. It was Peltier's first phone call since the transfer and prison beating.

During the call, Peltier said he will not be allowed "out of the hole" and in the general population.
Peltier said Canaan is a tough place, where gangs are being brought in. "He is one of the oldest ones there," Cowan said. "He will not be allowed back in the general population or he will be jumped."
Cowan said the FBI did tell Peltier that he was the victim in the attack, which she said was filmed on camera.Peltier said he was set up in the attack. "It was a cold blooded setup," Cowan said. She said he did not know his attackers. "He has never seen his attackers before."
Peltier said he will be allowed only one phone call every 30 days.
Cowan said she is hopeful that President Obama will work "nation to nation" with the Turtle Mountain Chippewas to bring Peltier home to North Dakota.
"We have to push for his transfer, he is not safe there."
During the NAMAPAHH Radio program tonight, Peltier's attorney was called by the prison. The prison will not allow his attorney to speak to him the next day, January 23.
"It is outrageous," said attorney Michael Kuzma of Buffalo, N.Y, concerning the co-counsel the prison has denied entry to speak with Peltier.
"What are they hiding?" Kuzma said they have hidden documents before, but not Leonard.
"Now they are hiding Leonard Peltier."
Earlier, the report of the beating came by way of a letter from Peltier.

Recently, the amount of hate mail circulated on the Internet regarding Peltier and appeals for his release has increased and could have played a role in the attack on Peltier.

The LPDOC said, "Retired, former and actively employed FBI agents have taken action against the release and parole of Leonard Peltier time and again. While it is their right to speak their opinion, it is not right to do so on federal time and at the taxpayer’s expense. Their letters, writings, articles, books, protests, outcries and interviews concerning Mr. Peltier, are a conflict of interest and tip the scales against him unfairly. In addition, it is certainly questionable as to the timing of a letter written by a former FBI Agent to Representative John Conyers and the beating Mr. Peltier received at Canaan."

The LPDOC said the attack on Peltier comes on the heels of the FBI's recent letter, prompting this attack by FBI supporters as an attempt to discredit Peltier as a model prisoner. "Anyone who has been in the prison system knows well that if you refuse to name your attackers or file charges against them, then you lose your status as a victim and/or given points against your possible parole and labeled as a perpetrator. It is not uncommon, in fact is quite common for the government to use Indian against Indian and they still operate under the old adage "it takes an Indian to catch an Indian," LPDOC said.

In 1978, the US government made an attempt to assassinate Peltier, offering another Indian inmate at Marion prison with Leonard Peltier, a chance at freedom. The man was Standing Deer. Standing Deer befriended Peltier in prison and exposed the plot to assassinate him. Standing Deer was murdered in Houston after his release from prison.

LPDOC said, "Standing Deer chose to reveal the plot to him instead of taking his life in exchange for a chance at freedom. When Standing Deer was released in 2001, he joined the former Leonard Peltier Defense Committee as a board member. He also began to speak on Leonard's behalf until his murder six years ago today. Prior to his murder, Standing Deer confided with close friends and associates that the same man who visited him in Marion to assassinate Peltier, had came to Houston and told him that he had better stay away from Peltier and anything to do with him," the LDPOC said. As of December, Peltier is eligible for a full parole hearing.  The hearing will likely occur this year, but no date has been announced, the LPDOC said.

When was he up for parole? I am in North Dakota but my heart and intentions will be with those in San Francisco who are standing up for all of us by standing up for Peltier. Jennifer

Dear Commissioners,

I am writing in behalf of support for Parole for Leonard Peltier. While I am aware of the seriousness of the conviction, I am also aware that people have the ability to go forward out of the past and give to the larger society. I believe that is the case with Leonard Peltier.

I ask you to consider the humanitarian work he has done during his 33 years of incarceration. More than most people can ever do who are not locked up.

I ask you to consider his nomination for the Nobel Peace Prize for the 6th straight year. There are those who make light of this, but who else among us have had that honor.

He consistently donates his art work for charities such as battered women's shelters, halfway houses, alcohol and drug treatment programs, and Native American scholarship funds.

Mr. Peltier has won several awards including the North Star Frederick Douglas Award; Federation of Labor (Ontario, Canada) Humanist of the Year Award; Human Rights Commission of Spain International Human Rights Prize; and 2004 Silver Arrow Award for Lifetime Achievement.

He has expressed sadness for the tragedy that occurred that day at Oglala and pain for the families of the two agents and the Indian man that died that day.

Thirty-three years is a long time. I ask you to look with empathy upon a 64 year-old man who, over the 33 years, has done so much good while in prison, and I think has the ability to do even more good for the community if he were to be allowed parole.

While I know of the misconduct by government officials in his case, I will not bring details up because I am certain that you are aware of the misconduct, and will consider that as you have the discretion to rule above or below the guidelines. I would hope that you will exercise that discretion in favor of Leonard Peltier. It seems to me it would be a gross miscarriage of justice if he were left to die in prison.

Please grant parole.

Parole

He's been eligible for parole for quite a while now. He'll never get it, though, because in order to get parole he has to admit guilt and say he's sorry and that he won't do it again. But since he never did it in the first place he won't admit guilt. So a presidential pardon is the only hope at this point, from what I understand from family members.

This was definitely a set up by the corrupt prison systems!

I am so upset to know what they did to Leonard! He was so set up by the system. The people that run the system are the ones that belong behind bars. Leonard should have never been incarcerated and he's spent more time in prison then people that have committed the worst crimes. I hope Obama make sure he gets release and sent home to his family where he belongs. The system is doing everything in their power to make sure that he is never released because they know once he is the world will find out the truth about our horribly corrupt system. My prayers are always with you Leonard and for your family.

The U.S System Sucks!!!

The U.S has the most stupid laws in the whole world!!! They prosecute illegal immigrants like prosecuting serial killers. They even hide any kind of information from their relatives. Clemency instead of Parole

Supporters and activists are asking for Clemency on behalf of Leonard Peltier. The authority to grant clemency by way of a computation of a sentence imposed by a federal court belongs only to the President (under Article II, Section 2 of the U.S. Constitution). My heart and prayers are with Leonard, and his family. FREE LEONARD PELTIER! I hate the Department of Corruptions. Why is it so o.k. for our people to be treated so badly. How come we let one of our own fall into never ending hell, Because we as Indian people need to learn how to unite as one. Stand for our own stop fighting each other. We are strong people! True Justice and Fairness

Those responsible for Peltier's attack should be held accountable. In the interest of fairness and justice, Leonard Peltier must also be held accountable for his crimes. He is, as recently noted elsewhere, an unrepentant guilty killer. In front of four witnesses, he bragged about shooting FBI Agent Ron Williams in the face at point-blank range. He interrogated murder victim Anna Mae Aquash by putting a loaded gun in her mouth, according to her daughters. In 1979, Peltier participated in an armed escape from prison where one man was shot and killed. Peltier is supported by people who neither care about the truth, nor care about his soul. They merely encourage his intransigence, which only seals his fate and holds him up as a false hero to Indian America. Until Peltier confesses his crimes and asks for forgiveness, he should never see the light of day as a free man.

It doesn't take a rocket scientist to figure out that with DNA evidence, this innocent man could be cleared. I have written President Barrack Obama, signed a petition on-line to the govenor, to free this man, and even called the white house. I am only one signature, one vote. Hopefully, it will make a difference. I strongly urge all of you to get involved and do the same. This man is old, and has been beaten in prison.(I e-mailed Amenesty International for that one!) Even if he was guilty, he doesn't deserve that! With enough press, people getting involved, and publicity, maybe one day, this man can go free! Leonard and I have never met and don't even know each other, but I am AGAINST racial discrimination for any reason.

Justice

With a Supreme Court vacancy coming up why not a Native American or a Mexican American? This is the only way we will get Justice. My name is Gabriel M. Robles of Lawrence, KS. and I already put my name in for consideration. First thing I'll do is hear arguments as to why Leonard Peltier cannot go free. The other justices will probably not be happy.
