DHS-ICE: Discrimination, Disparate and Uneven Disciplinary Procedures / Another Class Action Complaint of Discrimination? Why Not!
I have been contacted by several current special agents of the U.S. Immigration and Customs Enforcement (ICE) regarding EEO and Whistleblower Retaliation by their managers and supervisors. These contacts have been as a result of avid Narco News readers who have followed my news stories and those posted by my fellow co-publisher Bill Conroy regarding ICE and the Legacy U.S. Customs Service.
During my conversations with some of the ICE special agents, they have expressed a desire to file a class action complaint of discrimination against ICE.
Some of the agents who have contacted me have already attorneys representing them in various forums against ICE.
In order to facilitate any communication between any ICE special agent who is serious about engaging on a private, personal and confidential communication with me, directly or through their attorneys, I can be reached through my website at www.contrerasassociates.com.
A word of caution, ever since I filed my class action of discrimination against ICE-Legacy U.S. Customs Service in U.S. District Court in 2002 and have written for Narco News, my tax returns have been audited and examined every year. In fact, on September 13, 2008, I received a letter from the IRS telling me to be ready for an examination of my 2006 Tax return. I have taken certain measures to stop what I consider “harassment” – I realize that in life two things are for certain: paying taxes and death. Since I don’t have any problem with my tax filings, I welcome any tax examination. But year after year…the ritual becomes old and it is such a waste of my time trying to locate my receipts and the waste of monies manpower, and resources by IRS in trying to make a case because I happen to be…well…who I am, soon it gets pretty burdensome.
Still, there are some special agents who are hesitant to file any complaints or grievances for fear of retaliation and harassment.
I urge any ICE employee thinking about to file any complaint, to review the websites of the U.S. Equal Employment Opportunity Commission (EEOC) at www.eeoc.gov, the U.S. Office of the Special Counsel (OSC) at www.osc.gov, and the Merit Systems Protection Board (MSPB) at www.mspb.gov.
Remember, in addition to the protections afforded by the EEOC’s Office of Federal Operations, the OSC and MSPB, there is a criminal statute that apply to any complaint (s) filed by an ICE employee, any federal employee or civilian:
18 USC 1513 - Retaliating against a witness, victim, or an informant
